Terms of Service

These Terms of Service govern your use of Clasly.

Clasly is operated by Kira Gorbunova, trading as Clasly ("Clasly", "we", "us", or "our").

By creating, accessing, or using a Clasly account, you agree to these Terms.

1. Clasly

Clasly provides tools for tutors, teachers, and students to manage classes, assignments, documents, submissions, grades, feedback, communication, and related educational activities.

Teacher registration and paid subscriptions may be offered through the Clasly website and, for teachers using the Clasly iOS or iPadOS app, as an in-app subscription through Apple.

2. Accounts

You are responsible for keeping your login information secure and for activity conducted through your account.

Teacher account holders must be legally capable of entering into these Terms.

Student accounts may be created or provided by teachers or other authorized persons and may be used by minors.

Users must provide accurate information and must not impersonate another person.

3. Teachers and students

A teacher who creates or manages student accounts confirms that they are authorized to do so.

Teachers are responsible for ensuring that their collection and use of student information complies with applicable law, including obtaining parental or guardian authorization where required.

Students may only use Clasly through an account or access method legitimately provided to them.

4. Your content

You retain ownership of content that you upload or create through Clasly.

You grant Clasly a limited right to host, process, copy, transmit, display, and otherwise handle that content only as necessary to provide, secure, maintain, and improve the service and comply with applicable law.

You are responsible for ensuring that you have the right to upload or share content through Clasly.

5. Acceptable use

You must not use Clasly to upload, send, distribute, or store content that is unlawful, threatening, abusive, harassing, sexually exploitative, fraudulent, defamatory, malicious, or that infringes another person's intellectual-property or privacy rights.

You must not use Clasly to distribute malware, attempt unauthorized access, interfere with the service, circumvent security controls, scrape information without authorization, impersonate another person, or use the service to harm or exploit a child.

We may remove content, restrict features, suspend accounts, or terminate accounts where reasonably necessary to protect users, comply with law, investigate abuse, or enforce these Terms.

Users can report abusive users or content through available reporting tools or by contacting support@team.clasly.co.

6. User communication

Clasly may allow communication between teachers and students.

Users must use communication features appropriately and only for legitimate educational purposes.

Clasly may use technical and moderation measures designed to detect or restrict prohibited or abusive content.

Users may report inappropriate content or users and may use available blocking features.

Serious or repeated violations may result in suspension or permanent removal from Clasly.

7. Student-data processing

Where a teacher, tutor, or organization uses Clasly to process personal data concerning students and acts as the data controller, Clasly acts as a processor for that data.

Clasly will process that personal data only as necessary to provide the service and in accordance with the controller's documented use of Clasly, these Terms, and applicable law.

Clasly will take appropriate technical and organizational measures to protect personal data and will require persons authorized to process such information to maintain confidentiality.

Clasly may use subprocessors where necessary to provide the service. Clasly remains responsible for requiring appropriate data-protection obligations from those subprocessors.

Taking into account the nature of the processing, Clasly will reasonably assist controllers with data-subject requests, security obligations, and other applicable data-protection requirements.

Upon termination of the relevant service relationship, Clasly will delete or return personal data as appropriate, subject to legal obligations, security requirements, and ordinary backup retention.

Clasly will make reasonably necessary information available to demonstrate compliance with applicable processor obligations.

8. Payments

Paid teacher subscriptions, where applicable, are purchased either through the Clasly website, where payments may be processed by third-party payment providers such as Stripe, or inside the Clasly iOS or iPadOS app as an Apple in-app purchase.

Clasly Pro Monthly, purchased in the iOS or iPadOS app, is an auto-renewing subscription with a one-month billing period. Payment is charged to your Apple ID account at confirmation of purchase and renews automatically unless canceled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period. You can manage or cancel the subscription at any time in your Apple ID account settings. Billing, refunds and cancellation for Apple subscriptions are handled by Apple under Apple's terms.

A Clasly Pro subscription purchased through Apple or through the website gives access to the same Clasly Pro features on your Clasly account.

Prices, renewal terms, cancellation conditions, and other billing information are shown when a subscription is purchased.

Refund rights are governed by the applicable checkout terms and applicable law.

9. Account suspension and termination

You may stop using Clasly at any time.

Where supported, an account may be deleted from the Account section of the application.

We may suspend or terminate access where a user seriously or repeatedly violates these Terms, creates security or legal risk, abuses another user, or uses Clasly unlawfully.

10. Availability

We aim to keep Clasly available and reliable, but we do not guarantee uninterrupted or error-free operation.

Features may change as Clasly is developed.

We may perform maintenance, fix security issues, or discontinue features where reasonably necessary.

11. Educational responsibility

Clasly is an administrative and educational software platform.

Clasly does not guarantee academic results, grades, examination outcomes, teaching quality, or the accuracy of content uploaded by teachers or students.

Teachers remain responsible for their teaching, assessment decisions, and educational materials.

12. Liability

To the maximum extent permitted by applicable law, Clasly is not liable for indirect, incidental, special, or consequential losses arising from use of the service.

Nothing in these Terms excludes or limits liability or legal rights where applicable law does not permit that exclusion or limitation.

13. Changes

We may update these Terms where reasonably necessary because of changes to Clasly, legal requirements, security requirements, or our business.

The current version will be published on the Clasly website with the applicable update date.
